Welcome to AuraSkin ZA. These Terms of Service (“Terms”) govern your access to and use of our website, online store, products and related services.

By accessing our website or placing an order, you agree to these Terms, subject to any mandatory rights and protections available to you under applicable law. Please read them carefully before using our website or purchasing our products.

1. About AuraSkin ZA

AuraSkin ZA is a South African beauty and skincare brand offering skincare products, beauty devices, accessories and related beauty products.

In these Terms, “AuraSkin ZA”, “AuraSkin”, “we”, “us” and “our” refer to AuraSkin ZA.

Our online store is powered by Shopify, which provides the ecommerce platform through which we display and sell our products.

2. Eligibility and Acceptable Use

By using our website, you confirm that you are legally entitled to enter into the relevant transaction or that you have the permission or supervision required by applicable law.

You agree to use our website and services only for lawful purposes.

You must not:

  • Use our website to engage in fraudulent, deceptive or unlawful activity.

  • Attempt to gain unauthorised access to our website, systems or customer information.

  • Interfere with the security, availability or proper operation of our website.

  • Copy, misuse or infringe our intellectual property or the rights of other parties.

  • Submit false, misleading or fraudulent order information.

We may take reasonable steps to address suspected misuse, subject to applicable law.

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, prices and other information displayed on our website are accurate and current.

Actual product colours, packaging, dimensions and appearance may vary slightly due to photography, screen settings, manufacturer updates or packaging improvements.

Where a product is materially different from its description or does not meet applicable legal requirements, your rights under South African consumer law remain unaffected.

We may introduce new products, update existing products or discontinue products from time to time. Product availability is subject to stock and fulfilment capacity.

Nothing in this section removes any rights you may have concerning products already purchased.

4. Skincare Information and Results

Skincare and beauty products may produce different results for different individuals. Results can depend on factors such as skin type, product formulation, consistency of use and individual sensitivities.

Information provided on our website, in advertisements or through our social media channels is for general informational purposes. It is not intended to replace professional medical advice, diagnosis or treatment.

Customer reviews, testimonials, photographs and product demonstrations represent individual experiences and do not guarantee identical results for every customer.

Customers should:

  • Read the product label and usage instructions before use.

  • Follow the recommended application and usage directions.

  • Review ingredient information where available.

  • Discontinue use and seek appropriate advice if an unexpected reaction occurs.

If you have a known allergy, sensitive skin, a relevant medical condition or concerns about whether a product is suitable for you, consider consulting a qualified healthcare professional before use.

Nothing in these Terms excludes any legal responsibility relating to product safety, product quality or misleading product claims.

5. Beauty Devices and Electronic Products

AuraSkin ZA may offer beauty devices, including LED light therapy devices and other electronic or non-electronic skincare tools.

Customers must read and follow the instructions, warnings and safety information supplied with each device.

Do not use a device for purposes other than those for which it is intended. Where relevant, customers should follow the manufacturer's guidance concerning cleaning, charging, maintenance, storage and exposure limitations.

Customers should stop using a device if it appears damaged, malfunctions or causes an unexpected adverse reaction.

Unless expressly stated otherwise in the relevant product description, our beauty products and devices are not substitutes for professional medical care or treatment.

Nothing in this section limits your rights in relation to unsafe, defective or non-compliant products under applicable law.

6. Pricing, Discounts and Taxes

All prices are displayed in South African Rand (ZAR), unless otherwise indicated.

Prices, promotions and product availability may change from time to time. The applicable price will ordinarily be the price displayed at checkout when you place your order, subject to genuine errors and applicable consumer law.

We take reasonable care to ensure that prices and product information are accurate. If a genuine pricing or technical error is identified, we will take reasonable steps to contact affected customers and resolve the matter lawfully.

We will not use a pricing error as a means of disregarding an order or avoiding obligations that have already arisen under applicable law.

Any delivery charges, applicable taxes or other costs payable by the customer will be disclosed at checkout or otherwise communicated as required by law.

7. Orders and Order Acceptance

When you place an order, you may receive an electronic confirmation acknowledging receipt of your order. This acknowledgement does not necessarily mean that the order has been finally accepted or dispatched.

Orders may be subject to payment verification, stock checks, fraud-prevention measures and reasonable fulfilment checks.

We may contact you if information is missing, payment cannot be verified, a product is unavailable or another issue affects fulfilment.

Where an order must be declined or cancelled for a legitimate reason, we will communicate with the affected customer where reasonably practicable and handle any payment or refund due in accordance with applicable law.

Where payment has been collected for an order that is cancelled and a refund is due, the refund will ordinarily be returned through the original payment method where reasonably possible, unless another lawful arrangement is agreed.

Nothing in this section permits us to disregard an accepted order or a customer's statutory rights.

8. Payments

Payments are processed through the payment methods made available at checkout.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payment processing may be provided by third-party payment service providers. Their processing activities may be governed by their own terms, privacy policies and security procedures.

An order may not be processed until payment has been successfully authorised or received, where applicable.

If a payment fails, is reversed or is reasonably suspected to be fraudulent, we may contact you or take appropriate steps to verify the transaction, subject to applicable law.

9. Shipping and Delivery

We deliver orders to the destinations supported by our store and available courier services.

Delivery estimates are provided for guidance and are not guaranteed unless expressly stated otherwise. Delivery may be affected by courier capacity, public holidays, severe weather, customs procedures where applicable or other circumstances outside our reasonable control.

Customers must provide complete and accurate delivery information when placing an order.

If an incorrect address or incomplete information causes a delivery issue, we will work with the customer and courier to determine the appropriate next steps. Any additional charges or responsibilities will be handled transparently and in accordance with applicable law.

Risk, responsibility for delivery and any consequences of delayed, lost or damaged shipments will be determined in accordance with applicable law and the circumstances of the order.

Please consult our separate Shipping Policy for information about order processing, delivery estimates, shipping charges and delivery procedures.

10. Returns, Refunds and Order Cancellations

Returns, refunds, exchanges, defective products, damaged deliveries and order cancellations are handled in accordance with our separate Return & Refund Policy and applicable South African consumer law.

Certain change-of-mind returns involving opened or used skincare, cosmetic or personal-care products may be restricted for legitimate hygiene or safety reasons, where permitted by law and where applicable conditions are met.

However, hygiene considerations do not automatically remove a customer's rights relating to defective, unsafe, damaged, incorrectly supplied or otherwise non-compliant products.

Where the law provides a right to cancel, return a product, receive a replacement or obtain a refund, these Terms do not override that right.

Please contact admin@auraskinza.co.za if you experience a problem with an order. Where possible, include your order number and a description of the issue.

Please consult our Return & Refund Policy for the applicable procedures and timeframes.

11. Promotions, Discount Codes and Special Offers

AuraSkin ZA may offer promotional prices, discount codes, bundles, gifts, loyalty benefits or other special offers.

Unless otherwise stated, promotional offers may be subject to:

  • A specified promotional period.

  • Product availability and stock limitations.

  • Minimum spend or eligibility requirements.

  • Restrictions on combining multiple discounts.

  • Limits on the number of uses per customer or order.

The specific terms displayed with a promotion will apply to that offer.

We may correct genuine promotional errors or address fraudulent or abusive use of a promotion, subject to applicable law and any rights that have already arisen.

12. Affiliate, Ambassador and Creator Programmes

AuraSkin ZA may operate affiliate, ambassador, influencer or content-creator programmes.

Participation may be governed by separate written terms, campaign briefs or agreements.

Participants must comply with applicable advertising, consumer-protection and disclosure requirements. Promotional content must not make false, misleading or unsubstantiated claims about AuraSkin ZA products.

Unless expressly agreed in writing, participation in a programme does not create an employment relationship, partnership, joint venture or ownership interest in AuraSkin ZA.

Commission arrangements, content usage rights, payment conditions and other programme-specific requirements will be determined by the relevant agreement.

13. Customer Reviews and User-Submitted Content

Customers may be able to submit reviews, photographs, videos, comments or other content through our website or other communication channels.

By submitting content, you confirm that you have the necessary rights and permissions to provide it and that it does not unlawfully infringe another person's rights.

Where you grant permission for AuraSkin ZA to use your content, we may use it within the scope of that permission, including for displaying reviews, presenting customer experiences or promoting our products.

We will not interpret the mere submission of content as unrestricted permission to use it in every possible context.

Reviews should reflect genuine experiences and must not contain fraudulent, unlawful, abusive or deliberately misleading material.

We may moderate, decline or remove content that breaches our published rules or applicable law.

Any use of personal information, identifiable photographs or other personal content remains subject to applicable privacy and data-protection requirements.

14. Intellectual Property

The AuraSkin ZA name, logo, branding, original website content, graphics, product-page copy, designs and other original materials are owned by AuraSkin ZA or the applicable rights holders, as appropriate.

These materials may be protected by copyright, trademark and other intellectual property laws.

Except where permitted by law or expressly authorised in writing, you may not reproduce, distribute, modify, commercially exploit or otherwise use protected AuraSkin ZA materials without the relevant rights holder's permission.

Purchasing a product or accessing our website does not transfer ownership of our intellectual property to you.

Third-party names, trademarks, product images and other materials remain the property of their respective owners and may be subject to separate rights and restrictions.

15. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, courier providers, analytics services, advertising platforms, social networks and ecommerce applications.

Third-party services may have their own terms, privacy policies and operating procedures.

We are not responsible for the independent operation of external websites or services to the extent that the relevant matter is outside our responsibility under applicable law.

This section does not exclude responsibility for our own actions, representations, contractual obligations or legal duties.

16. Privacy and Personal Information

We may collect and process personal information required to operate our store, process payments, fulfil orders, communicate with customers, provide customer support and improve our services.

Our handling of personal information is described in our separate Privacy Policy and is subject to applicable data-protection requirements, including the Protection of Personal Information Act, 2013 (POPIA), where applicable.

Third-party providers may process certain information when delivering services on our behalf or providing their own services.

Please review our Privacy Policy for further information about the categories of information we collect, how it is used, relevant third-party disclosures, retention practices and applicable privacy rights.

17. Website Availability and Security

We aim to keep our website accessible and functioning properly, but we cannot guarantee uninterrupted access at all times.

Maintenance, technical faults, service-provider interruptions or other circumstances may temporarily affect website availability.

You must not attempt to compromise website security, introduce malicious code, interfere with other users or access systems or information without authorisation.

We may take reasonable steps to maintain, repair, secure or improve our website, subject to applicable law.

18. Limitation of Liability

Nothing in these Terms excludes, restricts or limits a right, remedy, warranty or liability that cannot lawfully be excluded or limited under South African law.

To the extent permitted by law, AuraSkin ZA will not be liable for indirect or consequential losses arising from circumstances beyond our reasonable control, where such exclusion is legally permitted.

We do not exclude responsibility for our own fraud, unlawful conduct, applicable statutory obligations or any other liability that cannot lawfully be excluded.

Customers remain responsible for following the instructions supplied with products and devices. However, this does not remove any rights or remedies that may arise from defective products, inadequate warnings, misleading representations or other failures for which we are legally responsible.

19. Indemnity

To the extent permitted by applicable law, you may be responsible for losses reasonably arising from your unlawful misuse of our website, fraudulent conduct or infringement of third-party rights.

Nothing in this section makes you responsible for losses caused by our own unlawful conduct or imposes obligations that would be unenforceable under applicable consumer-protection law.

20. Changes to These Terms

We may update these Terms to reflect changes to our business, products, services, website or legal requirements.

The latest version will be published on our website with its updated effective date.

Changes will apply prospectively where appropriate and will not unlawfully remove rights, remedies or obligations that have already arisen.

Where required by law, we will provide appropriate notice of material changes.

21. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa.

Any dispute relating to these Terms or a transaction with AuraSkin ZA will be handled in accordance with applicable South African law, including any mandatory consumer-protection rights and dispute-resolution procedures available to the customer.

Nothing in these Terms prevents a customer from exercising a statutory right or approaching a competent authority or forum where permitted by law.

22. General Provisions

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision on one occasion does not automatically waive our right to enforce it on another occasion.

These Terms should be read together with the applicable product information, Privacy Policy, Shipping Policy and Return & Refund Policy.

Where a provision conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail.
